GENERAL COUNSEL

As General Counsel for a community association we provide a level of expertise and confidence that has come from years of providing answers to the unique questions that a volunteer board of directors may face on a daily basis. One of the more typical responsibilities of general counsel is to advise the board on compliance with applicable State and Federal law. General Counsel services comprise a myriad of non-litigation matters. These services include, but are not limited to, the following:

  • Amend, preserve or reinstate an Association’s Governing Documents.
  • Provide Legal Opinions to the board interpreting the Association’s Governing Documents, Florida Statute, Federal Statutes and applicable caselaw or for financing and insurance purposes.
  • Negotiate, draft and/or review vendor contracts.
  • Attend or conduct annual, special and regular meetings of the membership or the board.
  • Provide advice and guidance to the Board with regard to Association governance and procedure.
  • Provide guidance with regard to property line, easement, or plat disputes.
  • Negotiate with local and state agencies and municipalities regarding applicable State and local obligations imposed upon a community association.
  • Provide the Board with a comprehensive developer turnover review and recommendations.
  • Provide guidance and advice with regard to the development and enforcement of architectural review guidelines for the community.

Erik Whynot is a Florida Bar Board Certified Specialist. Mr. Whynot has provided guidance to hundreds of community associations through the State of Florida. He regularly teaches and lectures on various topics affecting the community association industry, and boards of directors and CAM’s specifically. Mr. Whynot is certified by the Florida Department of Business and Professional Regulation to teach the following community association classes for continuing education credits:
