When the developer turns over and provides the key to the community to the owner board of directors, there may be issues related to the construction of the building, amenities, or community infrastructure that the developer should answer for and correct. These may be simply “punch list” items to be finished off or may be severe structural construction deficiencies in the community. Construction Defect litigation is complicated and requires a certain level of expertise and knowledge to correctly guide the board of directors and ultimately obtain relief for the community to address the deficiencies.
More importantly, Mr. Whynot and his team have a depth of experience in developing the most cost effective solution to obtain the relief for the Association to address developer deficiencies. The fee structure for construction defect litigation depends on the circumstances and damages being experienced by the community. We offer straight hourly fee, hybrid contingency fee and full contingency fee options depending on the specific case.
